The petitioner seeks bail in Yadopur P.S. Case No. 82/2018, instituted for the offences under Sections 272, 273 of the Indian Penal Code read with Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that from the seizure-list it is apparent that recovery has been made from the roof of Kishan Bhawan. The petitioner was arrested merely on suspicion as he was sleeping near the room of Kishan Bhawan, from where illicit liquor is alleged to have been recovered. In the seizure-list, it is mentioned that total 34.95 litres of foreign liquor has been recovered from the roof of Kishan

Patna High Court Cr.Misc. No.56529 of 2018 (2) dt.04-10-2018 2/2 Bhawan. Petitioner is in custody since 15.08.2018. Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge IInd-cum-Special Judge, Excise Act, Gopalganj in connection with Yadopur P.S.
