JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 504, 332, 333, 307, 427, 224, 225 and 353 of the Indian Penal Code and Section 17 of C.L.A Act. Allegation is that on getting information when police party proceeded and apprehended petitioner, then a mob consisting 40 to 50 persons used efforts and succeeded to get forcibly the petitioner free from the police and started abusing and pelting stones at the police force.

It has been submitted on behalf of the petitioner that he is in custody since 1.4.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. General and omnibus allegation has been made. No specific overt act has been alleged against the petitioner.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.30102 of 2016 (3) dt.06-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Salaiya P.S. Case no. 7 of 2016.
