Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the Indian Penal Code and Section 30(a)(d) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Country made liquor was allegedly recovered from the house of the petitioner. Petitioner is in custody since 15.02.2020. Investigation of the case is already complete. Petitioner has got a criminal antecedent of some different nature wherein he is already on bail.

Considering the entire facts, let the petitioner, above named, be released provisionally on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.17224 of 2020(2) dt.13-05-2020 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Atri P.S. Case No.35 of 2020, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

The provisional bail shall be confirmed only after framing of the charges.
