JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Bodhgaya P.S. Case No. 23 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 353, 307, 337, 338 and 427 of the Indian Penal Code and Section 30(d) of the Bihar Prohibition and Excise Act, 2016.
Prosecution story is that police recovered 50 kg Mahua flower from a village and thereafter more than 100 people assembled there including the petitioner and obstructed the police party.
Submission of learned counsel for the petitioner is that though he is named in the F.I.R., but nothing specific has been attributed against him. Further he has no criminal antecedent.
