JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-07-2022 At the outset, learned counsel for the petitioners submits that he seeks permission to withdraw this anticipatory bail petition, so far as petitioner no. 1 (Dilip Kumar) is concerned.
Accordingly, in respect of petitioner no. 1, this anticipatory bail petition is dismissed as withdrawn. Heard.
The petitioner no. 2 apprehends his arrest in a case registered for the offence under Sections 272, 273, 290, 34 of the I.P.C. and Sections 30(a), 34, 36, 38, 41, 56(d), 66(E) of Bihar Prohibition and Excise Act.
As per F.I.R., from the Baithaka of petitioner no. 1, total 189 liters of illicit foreign liquor has been recovered.

Considering the nature of allegation and clean antecedent of petitioner no. 2, let the above named petitioner no. 2, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Maniyari P.S. Case No. 40 of 2020, subject to conditions as laid down under Section 438(2) of the Cr.P.C. The application is, accordingly, disposed of. (Prabhat Kumar Singh, J) anay/- U T
