NATH ORAL ORDER 13-08-2015 Learned Counsel for the petitioner has submitted that the observations in the order dated 29.6.2015 passed in CWJC No. 16317 of 2014 is per in curium in view of the earlier Bench decision of this Court in the case of Durga Devi vs. Vijay Kumar Poddar & ors, 2010 (3) PLJR 954. It has been further submitted that the present revision application is thus not maintainable. Learned Counsel for the petitioner, however, prays for permission to convert this revision application into appropriate application in accordance with law.

Learned Counsel for the other side has appeared and has submitted that during pendency of this civil revision application or earlier to that due to the writ application the proceeding in the court below has been held up. It has been further pointed out by the learned Counsel for the Opposite parties that appropriate direction may be issued to the court below to proceed with the suit as there is no interim order of stay.

After hearing the parties, the prayer on behalf of the petitioner to convert this revision application into appropriate

Patna High Court C.R. No.71 of 2015 (3) dt.13-08-2015 application in accordance with law/rules is allowed and the petitioner is allowed two weeks' peremptory time to take appropriate steps for conversion as prayed.
