The petitioner seeks bail in Rajivnagar P.S. Case No. 237/2018, instituted for the offences under Sections 363 and 366(A) of the Indian Penal Code.

In the written report, it is alleged against this petitioner that he has kidnapped the minor daughter of informant for the purpose of performing marriage.

Learned counsel for the petitioner has submitted that victim girl has given statement under Section 164 Cr.P.C., wherein she has stated that she is in love with this petitioner and she has performed marriage with this petitioner. She has further stated that she wants to live with this petitioner in her Sasural. In

Patna High Court Cr.Misc. No.56508 of 2018 (2) dt.04-10-2018 2/2 her statement, she has disclosed her age to be 16 years. From the statement of daughter of informant recorded under Section 164 Cr.P.C., it appears that she had voluntarily gone with this petitioner and performed marriage with him.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IIIrd, Patna in connection with Rajiv Nagar P.S. Case No. 237/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
