1. Heard Mr. Basant Kumar Singh, learned counsel for the petitioner and Mr. Rajendra Singh, learned APP for the State.

2. The petitioner seeks regular bail in connection with Taraiya P.S. Case No. 428 of 2024 dated 15.11.2024 registered for the offence(s) punishable under Section(s) 109, 103(2) and 3(5) of the B.N.S and Section 27 of the Arms Act. 3.

The main submissions advanced by the petitioner's counsel are that though the petitioner is named in the FIR but he is not alleged to be the main assailant and co-accused Parhalad Manjhi is said to be the main assailant who allegedly opened fire at the deceased, son of the informant and as per the FIR, the petitioner was simply present at the place of occurrence

Patna High Court CR. MISC. No.19578 of 2025(2) dt.22-04-2025 2/3 along with other co-accused persons but any his specific role in the commission of the alleged offence has not been revealed. It is further submitted that the petitioner has fair and clean antecedent and languishing in jail since 18.11.2024 and against him the investigation has been completed and one co-accused Ramnath Manjhi @ Ramnath Mahi carrying similar nature of allegation has been granted the relief of bail by co-ordinate bench of this court vide order dated 16.04.2025 passed in Cr. Misc. No. 17376 of 2025.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of the case as well as considering the aforesaid submissions and mainly the fact that the co-accused Parhalad Manjhi is said to be the main assailant causing firearm injury to the deceased and petitioner's specific role in the alleged crime has not been revealed in the FIR and coupled with petitioner's fair and clean antecedent as well as completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Taraiya P.S. Case No. 428 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the
