====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sanjhauli P.S. Case No. 117 of 2021 lodged under Sections 379 & 511 of the Indian Penal Code.

Learned counsel for the petitioner submits that from the F.I.R. itself it transpires that offence under Section 379 of I.P.C. has not been constituted, only attempt is alleged to have been made, similarly Section 511 is not attracted in the present case. On the point of criminal antecedent of petitioner, learned counsel for the petitioner submits that petitioner is a law abiding citizen, at the instance of police, series of cases have been filed but in each and every case he is on bail. Learned counsel for the petitioner submits that petitioner is in jail since 04.11.2021. He further submits that petitioner shall appear before lower court on

Learned counsel for the State submits that it is true that offence under Section 379 of Indian Penal Code has not been constituted as per the allegation in the F.I.R. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, District Rohtas in connection with Sanjhauli P.S. Case No. 117 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.

With this observation, the bail application stands allowed.
