JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2023 The present writ petition has been filed for directing the respondents, particularly the Block Development Officer, Gurua, Gaya and Block Development Officer, Atari i.e. the respondents no. 3 and 7 to pay the arrears of salary to the petitioner, which has been withheld from the month of October 2004.

The learned counsel for the respondent-State has referred to paragraph no.18 and 20 of the counter affidavit, filed in the present case, to submit that delay has taken place on

Patna High Court CWJC No.22396 of 2013(2) dt.22-06-2023 2/2 account of non-availability of the last pay certificate, however the process has been initiated to make payment of the arrears of salary to the petitioner herein, hence in case the same has not been paid, the same would definitely be paid, within a period of four weeks from today. It is directed accordingly. It is needless to state that in case the admitted outstanding amount of arrears of salary of the petitioner is not paid, within a period of four weeks of receipt/production of a copy of this order before the District Magistrate, Gaya, the District Magistrate, Gaya shall not draw his salary. The writ petition stands disposed off on the aforesaid terms.
