JUSTICE RAVI RANJAN ORAL ORDER 20-02-2015 I have heard learned counsel for the petitioner, the State and the complainant.
The petitioner apprehends his arrest in connection with Complaint Case No. 34(C) of 2014 instituted under Sections 406, 420, 467, 468 and 120(B) of the Indian Penal Code. As per the allegation, by creating a fictitious company, the accused persons have cheated several lacs rupees from the local people. The complainant claims to be the collecting agent of the company and after collecting several lacs from the local people he had given to the company concerned but, thereafter, the company has been closed. Petitioner claims that he is merely an employee working in the company concerned and has nothing to do with the affairs of the company. He is also not involved in any policy
Patna High Court Cr.Misc. No.36822 of 2014 (2) dt.20-02-2015 2/2 making including floating of alleged lucrative and fictitious schemes for depositors. He was acting as per command of the employer company.
Learned counsel for the complainant has also accepted at the time of hearing that petitioner was merely an employee of the company.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Rajiv Kumar Ranjan @ Rajeev Kumar Ranjan be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Complaint Case No. 34(C) of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur (Supaul) subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
