The petitioner being brother's wife of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under sections 304(B), 201 and 120B of the Indian penal Code.

Accusation is killing the sister of the informant about seven years of marriage for non-fulfillment of dowry demand..

It is submitted by the learned counsel for the petitioner that marriage was performed more than seven years prior to the occurrence hence this case doles not come within the pperview of section 304B of the Indian Penal Code. It is further

Patna High Court Cr.Misc. No.33684 of 2015 (2) dt.13-08-2015 2/2 submitted that the husband of the victim is in custody. The petitioner is separate from the husband of the victim. Considering the fact that the victim died after about seven years of the marriage and the petitioner being lady, the above named petitioner in the event of her arrest or surrender before the court below within a period of 12 weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M, Supaul in Kishanpur P.S. Case No. 56 of 2015, subject to the conditions laid down under section 438(2) Cr.P.C.
