Petitioner seeks bail in Sanokhar P.S. Case No.02 of 2018 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.
Counsel for the petitioner submits that there is no eye witness to the occurrence.
In the written report, it is alleged that brother of the informant had gone in the neighbouring village with his brother and uncle. Randhir Kumar Singh told his uncle and one Dhiraj that he is coming after purchasing cigarette from the shop of Devi Lal Murmu. All of sudden, they saw that these petitioners
Patna High Court CR. MISC. No.18048 of 2019(4) dt.04-07-2019 2/2 along with other named accused persons total 8 persons started dragging Randhir Kumar Singh inside the house. The uncle and brother of the informant fled away out of fear. They again went in the night to enquire about Randhir, but they did not give reply. In the morning, dead body of Randhir was found near bank of the river.
Counsel for the State has submitted that in the case diary it has come that blood stained T-shirt has been recovered from the house of Devi Lal Murmu. There is no eye witness of the occurrence in the entire case diary.
Petitioner is in custody since 27.11.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Bhagalpur, in connection with Sanokhar P.S. Case No.02 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
