JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sour Bazar (Police Shivir Baijnathpur) P.S. Case No. 331 of 2018 registered for the offences punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code. Allegation as per FIR is that second marriage of the deceased Bipin Yadav was solemnized with Kajal Kumari, daughter of Ramseth Yadav, due to which the entire family members were unhappy and earlier also they tried to kill the deceased but anyhow he had fled away. Further case is that on 3.6.2018 informant got telephonic information that her husband Bipin Yadav was murdered and dead body was brought to Sadar Hospital, Saharsa. Petitioner is not named in the FIR and later on his name transpired in the confessional statement of coaccused and petitioner is accused in 15 other cases.
Patna High Court CR. MISC. No.17998 of 2019(3) dt.17-06-2019 2/2 Submission of learned counsel for the petitioner is that he has falsely been implicated only because he has criminal antecedents and petitioner is not family member of Ramseth Yadav.
Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that confessional statement disclosed participation of the petitioner in killing the deceased and apart from that he is accused in several other cases. In view of above facts and circumstances and as investigation is also going on, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, dismissed.
