Petitioner apprehends his arrest in connection with Mahkar P.S. Case No.105 of 2020 dated 19.09.2020, registered for the offence punishable u/s 363/366 of the IPC, pending in the Court of learned S.D.J.M., Gaya.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order,

Patna High Court CR. MISC. No.23965 of 2024(2) dt.27-03-2024 2/2 preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that the petitioner has no criminal antecedent and he is not named in the F.I.R. The Court below should follow the order passed by the Apex Court in the case of Satendra Kumar Antil v/s. Central Bureau of Investigation & Anr. as reported in (2022) 10 SCC 51.
