The petitioner being the husband of the victim is languishing in custody since 28.11.2014 in a case initially registered for the offences under sections 341, 323, 307, 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act but after the death of the victim section 304B/34 has been added. Prosecution case is that the informant got information that his sister has been caused burn injury and admitted in S.K.M.C.H., Muzaffarpur for treatment. The informant came to know about the injury caused by the petitioner being the husband and other family members by the victim herself. It appears from the report of the learned 3rd Addl. Sessions Judge, Muzaffarpur dated 21st July, 2016 that five witnesses have been examined and only informant, doctor and I.O.

Patna High Court Cr.Misc. No.26747 of 2016 (3) dt.29-07-2016 are left to be examined against whom bailable warrant has been issued and the trial is likely to be concluded within four months. In view of the present stage of the trial, this Court is not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is, accordingly, rejected.

The learned trial court is directed to conclude the trial expeditiously, within the time frame transmitted to this Court. It is expected by the Sr. S.P., Muzaffarpur to see that the witnesses are produced on the date fixed in the trial.
