JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the F.I.R., this petitioner along with other accused persons arrived at tea stall of Vijay Yadav situated at Maraiya and co-accused Sonu Kumar fired upon the informant. As a result he sustained injury on his chest. It is submitted by the learned counsel for the petitioner that the specific accusation of firing is against the coaccused person Sonu Kumar. So far as this petitioner is concerned there is no specific allegation or overt act leveled against him. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 504 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
