2. The petitioner has preferred this application for grant of regular bail in connection with Khagaria (Muffasil) P.S. Case No. 653 of 2023 G.R. No. 2145 of 2023 dated 01.07.2023 registered for the offences punishable u/s 341, 323, 307 read with Section 34 of the IPC and Sections 27, 25(1-B)a of the Arms Act.
3. As per the prosecution case, on a secret information of the occurrence of firing upon the villager of Amni, police reached the village, Mehsauri and arrested coaccused Sunny Kumar. Co-accused Sunny Kumar disclosed about the complicity of Kanhaiya, Shoab, Idia, Tufani and Santa
Patna High Court CR. MISC. No.18627 of 2025(2) dt.23-04-2025 2/3 Paswan @ Santbali Paswan, (petitioner) in the alleged occurrence of firing.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to disclosure made by the co-accused Vikki Kumar. There is no specific allegation of firing against the petitioner. No incriminating articles has been recovered from the physical or conscious possession of the petitioner. It is submitted that no one has sustained any fire arm injury from the alleged occurrence of firing. The petitioner has eight criminal antecedents out of which in seven cases he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 12.12.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 653 of 2023, G.R. No. 2145 of 2023, with the
Patna High Court CR. MISC. No.18627 of 2025(2) dt.23-04-2025 3/3 condition- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
