The petitioners seek bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, about 295 litres of foreign liquor was recovered from a Scorpio vehicle which was being boarded by the petitioners. It is contended that nothing has been recovered from the conscious possession of the petitioners. Petitioners claim that they are having clean antecedent and are in custody since 28.07.2018. No.58378 of 2018(2) dt.06-10-2018 2/2 case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gopalganj, in connection with Excise Case No. 167 of 2018 (Gopalganj) with further conditions that one of the bailors of the petitioners must be the resident of State of Bihar.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
