The petitioner seeks bail in connection with Bithan P.S. Case No. 59 of 2013 registered for the offences punishable under sections 147, 148, 149, 341, 323, 325, 307 and 302/120(B) of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that co-accused Fokasia Yadav, Mohan Mukhiya, and Nandan Mukhia @ Nandan Sahni having more or less identical allegation have already been granted bail by different Benches of this Court vide Criminal Misc. Nos. 51879 of 2013, 10688 of 2014 and 4539 of 2015.

Learned counsel for the State does not controvert

Patna High Court Cr.Misc. No.35226 of 2016 (2) dt.20-08-2016 the aforesaid submissions made by the learned counsel for the petitioner.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri L. N. Triapthi, Judicial Magistrate 1st Class, Rosera, Samastipur in connection with Bithan P.S. Case no. 59 of 2013.
