2. The petitioner is apprehending arrest in connection with Shankarpur P.S. Case No. 204 of 2023 lodged on 08.12.2023, for the offence punishable under Sections 341, 323, 324, 325, 307, 504 & 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against 18 named accused persons including the present petitioner against whom there is allegation that they have assaulted the informant and specific allegation against the petitioner is that he has assaulted the informant by dabia due to which injury has been caused.

4. Learned Counsel for the petitioner submits that the

Patna High Court CR. MISC. No.22753 of 2025(2) dt.01-05-2025 2/2 petitioner is innocent and has committed no offence. Counsel submits that the petitioner's case is exactly similar to that of persons who have been granted bail by the Co-ordinate Bench of this Court vide order dated 26.10.2024 passed in Cr. Misc. No.46090 of 2024. Counsel further submits that the criminal antecedent of the petitioner is clean and he is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that the Sessions Court after call for case diary has minutely observed and found that against petitioner, there is allegation of assault by dabia on the head of the informant and his brother and there is hairline fracture on the left parietal bone which is grievous in nature as per the Doctor's report.

6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected. (Dr. Anshuman, J) Divyansh/- U T
