Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

25.560 litres of foreign liquor was allegedly recovered from the cowshed of the petitioner. Petitioner has got identical criminal antecedent. Petitioner is in custody since 28.01.2020. Submission is that the recovery is not alleged from conscious possession of the petitioner. Investigation of the case is already complete against the petitioner.

Considering the facts of this case, let the petitioner, above named, be released on bail provisionally on furnishing

Patna High Court CR. MISC. No.17071 of 2020(2) dt.13-05-2020 2/2 bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Begusarai Muffasil Police Station Case No. 386 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

The provisional bail shall be confirmed only after framing of the charges.
