Pursuant to the earlier order of this Court dated 20.07.2015, a report of the medical board constituted by the All India Institute of Medical Sciences, Patna dated 28.07.2015, has been received which declares the petitioner medically fit in all respect and his category is defined as Shape-1, this Court would now expect the authorities of the C.R.P.F. to re-consider the case of the petitioner for his candidature in respect of limited
Patna High Court CWJC No.4033 of 2015 (7) dt.05-08-2015 departmental competitive examination for recruitment on the post of Head Constable by ignoring the result of the review medical board dated 17.12.2014. In other words, the medical fitness standard of the petitioner shall be governed by the report of the medical board of All India Institute of Medical Science, Patna, a copy whereof is made available to Mr. Sanjay Kumar, learned counsel appearing on behalf of the respondent authorities of the C.R.P.F.
In view of the report of the All India Institute of Medical Science, Patna this Court will have no difficulty in quashing the order dated 17.12.2014, declaring the petitioner to be medically unfit for recruitment on the post of Head Constable, and consequently also declaring the petitioner to be medically fit for recruitment on the post of Head Constable. An appropriate decision now by treating the petitioner to be medically fit for his recruitment on the post of Head Constable should be taken in accordance with law within a period of four
Patna High Court CWJC No.4033 of 2015 (7) dt.05-08-2015 months from the date of receipt of this order. That being so, this application stands allowed. Let a copy of this order along with the report of the medical board of the All India Institute of Medical Science, Patna be made available to Mr. Sanjay Kumar, learned A.S.G.
