Petitioner seeks bail in a case registered under sections 377, 511 of the Indian Penal Code and sections 25 (I-b) a, 26 of the Arms Act.

Petitioner is in jail custody since 10.2.2016 on the accusation that he wanted to commit unnatural offence with the victim and firearm was recovered from his conscious possession. Admittedly, recovery of firearm has been made by private person and so far as allegation of unnatural offence is concerned, victim, himself, admitted that the petitioner has not committed unnatural offence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.26323 of 2016 (2) dt.11-07-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, Judicial Magistrate, Ist Class, Begusarai in Neema Chandpura P.S. Case no. 09/2016.
