The petitioner apprehends his arrest in a case under section 302 and other sections of the I.P.C.
The informant alleged that his Tractor with Tailor was hired by Ramesh and some other persons but his driver did not return with the Tractor and Trailer. The informant suspected that the petitioner and others must have killed his driver after taking Truck and Trailer.
Learned counsel for the petitioner submits that the petitioner is named in the F.I.R. but only on suspicion, it is alleged that the petitioner and others kidnapped the driver of the informant and killed him.
It appears from perusal of the records that many witnesses, namely, Pappu Thakur and others have stated that the petitioner had also participated in the killing of Md. Jasim, the driver of the Tractor and co-accused have also named the petitioner.
Patna High Court Cr.Misc. No.40537 of 2014 (2) dt.30-03-2015 Considering the facts and nature of allegation and the fact that the offence is very heinous in nature, I am not inclined to enlarge the petitioner on anticipatory bail, and accordingly, the same is rejected.
