The petitioner seeks bail in Kochadhaman P.S. Case No. 229 of 2018, instituted for the offence under Section(s) 302, 201 and 120-B/34 of the Indian Penal Code. It is alleged in the written report that son of the informant namely, Muzammil Hayat (Sarpanch) had gone to Haldikhora in Panchayti. After Panchayti, he was returning to his village but he did not reach to his house in the night. It is further alleged that in the next morning, the informant learnt that dead body of his son was lying in the east of Titiha Chauk near bank of river. The informant went there and saw his son lying dead. His neck was cut. It is alleged in the written report that petitioner and other accused persons have committed
Patna High Court CR. MISC. No.21935 of 2019(2) dt.30-05-2019 2/2 murder of his son.
Counsel for the petitioner submits that informant is not eye witness of the occurrence. Mere suspicion has been raised against the petitioner.
Petitioner is in custody since 22.12.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S.
