Petitioner prays for bail in connection with P.R. Case No. 40 of 2018, arising out of Misc. Excise Case No. 571 of 2018, registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of 17,702 litres of country made liquor and petitioner was arrested while fleeing away from the place of occurrence.
Submission of learned counsel for the petitioner is that recovery has been made from the public place and not from his possession and he is in custody since 4.8.2018, having no criminal antecedent and charge sheet in this case has been submitted. Heard learned APP also.

No.57713 of 2018 (2) dt.28-09-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cum-Special Judge, Excise Act, Supaul, in connection with P.R. Case No. 40 of 2018, arising out of Misc. Excise Case No. 571 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
