2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 365 and 34 of the B.N.S., 2023.
3. As per prosecution case, on 22.10.2023 at about 04:00 PM, this petitioner called the husband of the informant on mobile and took him somewhere, thereafter, husband of informant did not return. Informant suspects that this petitioner along with other named accused persons under a planned conspiracy has kidnapped her husband with an intention to kill him.
4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the
Patna High Court CR. MISC. No.20549 of 2025(4) dt.15-10-2025 2/2 present case merely on the basis of suspicion. Similarly situated co-accused person namely, Samir Shah @ Sabirul Ali has been granted the privilege of anticipatory bail by this Court vide order dated 06.02.2025 passed in Cr. Misc. No. 50023 of 2024.

Learned APP for the State has on the other hand vehemently opposes the prayer for anticipatory bail and submits that in the FIR itself, it is the specific case of the informant that it was this petitioner who called the husband of the informant by mobile and took him away and thereafter, the husband of the informant became traceless. Petitioner was last person seen with the victim.
6. Considering the facts and circumstances of the case as well as the heinous nature of allegation levelled in the FIR, the prayer for grant of anticipatory bail to the petitioner is rejected.
