ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner being mother-in-law is apprehending her arrest in Bihta P.S.Case No.376/10 for the offences under Sections 341, 325, 302 and 498A/34 of the I.P.C. Learned counsel for the petitioner submits that after marriage of the informant, namely, Chandni Devi with Munna Kumar, her in-laws people used to demand dowry and due to nonfulfillment of the same on 5.12.2010 they sprinkled kerosene oil on the informant with intent to kill her and when they tried to do so the husband of the informant protested upon which the bhaisur of the informant gave iron blow on the head of the husband of the informant causing injury who in course of treatment in P.M.C.H. succumbed to his injuries. Learned counsel for the petitioner submits that earlier the petitioner had not been sent up for trial but after differing from the said final form the learned Magistrate had taken cognizance under Section 498A and 302/34 of the I.P.C. He further submits that earlier also this petitioner had moved this Hon'ble Court for grant of anticipatory bail whereby he was extended privilege of anticipatory bail vide Cr.Misc. No.40490 of 2011 on 9.12.2011 but since in the meantime bond could not be filled up and cognizance was also taken the petitioner is constrained to move again for the same relief. Considering the aforesaid facts and circumstances and nature of allegation, let the petitioner, above named, in the event of her arrest or surrender before the court below within three weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Thakur, J.M. 1st Class at Danapur, in Bihta P.S.Case No.376/10 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
