Petitioner already in custody in connection with Sessions Trial No.422 of 2016, arising out of Manjhi P.S. Case No.23 of 2016, is an accused in a case registered under Sections 302 and 498(A)/34 of the Indian Penal Code.

Allegation in brief is that the informant's daughter was married with the petitioner in the year 2007 and all accused used to torture her and killed.

Submission is that the petitioner is the husband. In the case diary evidence has been collected, which shows that the petitioner was habitual drunkard and his wife used to object this habit, therefore, she committed suicide as per the post-mortem and this petitioner has been in custody since 29.02.2016.

No.43917 of 2016 (3) dt.08-03-2017 2 / 2 Having considered the said facts and circumstances, let the petitioner, namely, Mahendra Bharti be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, Chapra, District Saran in connection with Session Trial No.422 of 2016, arising out of Manjhi P.S. Case No.23 of 2016.
