Petitioner prays for bail in connection with N.H. Bangra P.S.Case No. 33 of 2018 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. Allegation as per FIR is of kidnapping of minor daughter of the informant and it is suspected that one Santosh Kumar Shah has enticed her away and also there is hand of the petitioner, who happens to be sister of said Santosh Kumar Shah, and other accused persons in the said kidnapping.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated only because she is sister of said Santosh Kumar Shah and she is in custody since 15.5.2018 and charge sheet has been submitted in this case.

Patna High Court Cr.Misc. No.58080 of 2018 (2) dt.08-10-2018 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail on the ground that the girl is still traceless.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Samastipur, in connection with N.H. Bangra P.S.Case No. 33 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner will co-operate the police in tracing out the girl, otherwise her bail bond shall be cancelled.
