Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with

Patna High Court CR. MISC. No.20036 of 2022(2) dt.21-07-2022 2/3 Desari P.S. Case No. 160 of 2020 lodged under Section 392 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. and F.I.R. has been lodged against four unknown persons. Learned counsel for the petitioners further submits that their name have figured in this case by the confessional statement of the co-accused namely, Pintu Kumar and Vikash Kumar. They further submits that the co-accused Vikash Kumar and Pintu Kumar have already been granted bail by the Co-ordinate Bench of this Court vide order dated 30.11.2021 and vide order dated 20.07.2021 passed in Cr. Misc. No. 21050 of 2021 and Cr. Misc. No.19421 of 2021 respectively. They also mentioned that criminal antecedent of both the petitioners are clan and petitioners, namely, Manish Kumar and Vikrant Kumar are in judicial custody since 19.02.2022 and 16.02.2022 respectively.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the

Patna High Court CR. MISC. No.20036 of 2022(2) dt.21-07-2022 3/3 satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/ J.M.Ist Class, Vaishali at Hajipur in connection with Desari P.S. Case No. 160 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

Both the petitioners are directed to present each and every date before the lower Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of their bail bonds.

With this observations, the bail application is disposed of.
