The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 325, 307, 337, 338, 353, 427, 435, 436 of the Indian Penal Code, 27 of the Arms Act and 3/4 of Prevention of Defacement of Property Act, 1987.

It is alleged that on protest against the death of a cyclist in road accident the mob damaged the public property, attacked police force and thereby obstructed the police in discharge of official duty.

It is submitted by learned counsel for the petitioner that the accusation is against the mob and a statement

Patna High Court Cr.Misc. No.33813 of 2015 (2) dt.31-08-2015 2/2 has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation against the mob, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 622 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
