Petitioners seek bail in connection with Birpur P.S. Case No. 40 of 2016 registered for the offence punishable under sections 341, 323, 307, 504/34, 302 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to admitted land dispute between the parties. Petitioners are not named in the first information report and there is nothing specific alleged against them. The specific allegation is against other co-accused persons. Petitioners have no criminal antecedent. Petitioner no.1 is in custody since 18.05.2018 and
Patna High Court Cr.Misc. No.61333 of 2018(2) dt.08-10-2018 2/2 petitioner nos. 2 to 4 are in custody since 26.06.2018. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Begusarai in connection with Birpur P.S. Case No. 40 of 2016.
