2. The present modification application has been filed on behalf of the petitioner seeking modification of the order dated 08.12.2023 passed in Cr. Appeal (SJ) No. 2855 of 2023, by which the petitioner was granted anticipatory bail by a Coordinate Bench of this Court, to the limited extent of extending the period prescribed for furnishing bail bond and sureties before the learned court below.
3. Learned counsel appearing on behalf of the petitioner submits that due to unavoidable circumstances the petitioner could not surrender before the learned court below
Patna High Court CR. MISC. No.21789 of 2026(2) dt.21-07-2026 2/3 within the stipulated period. It is, therefore, prayed that further time may be granted to enable the petitioner to surrender and furnish the required bail bond along with sureties.
4. It is further submitted that the petitioner is ready and willing to deposit a sum of Rs. 5,000/- (Rupees Five Thousand only) with a charitable organization, without prejudice to his rights and contentions in the present matter.
5. Having considered the facts and circumstances of the case and the submissions advanced on behalf of the petitioner, the present modification application stands allowed.
6. Accordingly, the petitioner is granted further time of four (04) weeks from today to surrender before the learned court concerned and furnish bail bond and sureties, subject to the condition that the petitioner shall deposit a sum of Rs.5,000/- (Rupees Five Thousand only) with Ramakrishna Mission Sevashrama, Swami Vivekananda Path, Bela, Muzaffarpur, Bihar and shall produce the original valid receipt evidencing such deposit before the learned court below at the time of surrender.
7. It is made clear that the bail bond of the petitioner shall be accepted by the learned court concerned only after due verification of the genuineness and validity of the said receipt.
