2. The petitioner is apprehending arrest in connection with Barhara P.S. Case No. 193 2022 instituted under Sections 302, 420, 34 of the Indian Penal Code lodged on 12.03.2022 by the informant, Sanjay Sah.

3. Learned counsel for the petitioner prays for withdrawal of the petition.

4. A counter affidavit filed by Mr. Jitendra Kumar Singh on behalf of Civil Surgeon cum Chief Medical Officer Bhojpur, Ara has come in the matter which clearly shows that though the same is not functional, it in no way, can be construed as a Hospital, as according to the inspection report, two bed room was found on inspection.

5. Mr. Prashant Pratap, learned GP- 2 who is assisting the Court in few such matters relating to the registration of the l to 40 beds as provided vide notification no. 18/Misc.-18/2025-

Patna High Court CR. MISC. No.21604 of 2026(3) dt.19-06-2026 2/2 555(18)/health dated 03.06.2026 to show that the Government has taken step to ensure that even those Hospital/Maternity Home/Nursing Home/Sanatorium which want to function with 1 to 40 beds, will have to get themselves registered.

This Court would like to put on record its word of appreciation for both Mr. Jitendra Kumar Singh, learned APP and also Mr. Prashant Pratap, learned GP-2 for taking steps which ultimately will help the citizen of the state inasmuch as the illegal Nursing Home/Maternity Home/Hospital which have come across the State will be flushed out once the registration of such institution becomes mandatory.

8. Learned GP-2, Mr. Prashant Pratap submits that as per his instruction, the Health Department will be taking all possible steps to ensure that those who are functional, within a stipulated period, they get themselves registered, following the issuance of the present order.

9. As prayed for, petition stands dismissed as withdrawn.
