JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
Allegation is that while informant was coming after collecting money of Rs.4,87,000/-, three accused persons snatched the money and fled away.
It has been submitted on behalf of the petitioner that he is in custody since 18.3.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of the co-accused. He has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
