JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 At the very outset, it is submitted that during the pendency of this application, petitioner nos.1 Md. Ainul and 2. Md. Alam have been arrested, as such this application against the petitioner no.1 and 2 is dismissed as withdrawn. So far petitioner nos.3 Md. Verasat and 4 Md. Kalam @ Md. Abdul Kalam are concerned, they are apprehending their arrest in connection with Bahadurpur Case No.458 of 2018 , registered for offences punishable under Sections 147, 148, 149, 447, 341, 332, 324, 307, 504, 509, 379, 427 of the I.P.C. It is submitted that there is no specific allegation against the petitioner no.3 and so far petitioner no.4 is concerned, there is allegation of assault by bricks.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.23411 of 2019(4) dt.24-06-2019 2/2 that there is case and counter case and the injuries are simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner nos.3 and 4, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Bahadurpur P.S.Case No.458 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is disposed of.
