JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Petitioner is permitted to make necessary correction in para-1 of the petition within course of the day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Petitioner happens to be younger brother in law of the deceased and admittedly, the marriage of deceased had taken place nine years ago and after that she gave birth to two children but informant claims that the husband of the deceased used to quarrel with deceased as she was unable to produce male child and
Patna High Court Cr.Misc. No.28534 of 2016 (2) dt.18-07-2016 2/2 subsequently, it is claimed that she was killed by her husband as well as petitioner and her dead body was cremated. Submission on behalf of the petitioner is that the investigation against the petitioner has already been completed and except suspicion, nothing has been brought on the case diary against the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Madhubani in connection with Sessions Trial No. 162 of 2016 arising out of Raj Nagar P.S. Case No. 29 of 2016.
