Petitioner seeks bail in Kajra P.S. Case No.31 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code, Section 27 of the Arms Act and Sections 16, 17, 18, 20, 23 UAP Act.
Counsel for the petitioner submits that name of the petitioner has come merely on suspicion. He has been named along with other accused merely on suspicion. It is alleged that CRPF personnel along with local police were engaged in committing raid on the Naxali team. The Naxals started firing causing injury to some of the police personnel.
There is no allegation of any specific overt act against the petitioner.
Patna High Court CR. MISC. No.21394 of 2019(4) dt.29-05-2019 2/2 Counsel for the petitioner further submits that coaccused, Mukesh Yadav, has already been granted regular bail by co-ordinate Bench of this Court by order dated 06.03.2019 passed in Cr. Misc. No.13533 of 2019.
Petitioner is in custody since 04.12.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Lakhisarai, in connection with Kajra P.S. Case No.31 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
