2. It has been submitted by the learned counsel for the petitioner that in the impugned orders passed by the Circle Officer, Lakhisarai and the District Magistrate Lakhisarai complicated question of title has been decided by them in a summary proceeding which is not permissible.

3. So far as the merits of the case of the petitioner is concerned, he further submits that he may be permitted to file a title suit in the district Court.

4. The petitioner is permitted to do so in the district Court along with the injunction application and press his injunction application.

5. If any title suit is filed and along with an injunction petition then the injunction petition must be disposed of by the concerned officer within a period of two months of its filing.

6. With the aforesaid directions, this application is disposed of.
