JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

It is alleged by the informant that her widow sister-inlaw was killed at the hands of the petitioner being nephew as the brother-in-law of the victim wanted to grab the share of land of the victim.

It is submitted by learned counsel for the petitioner that accusation has been levelled only on the basis of suspicion. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.34338 of 2015 (2) dt.17-08-2015 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Anti P.S. Case No. 13 of 2015 pending in the court of learned CJM, Gaya.

Accordingly, the application is disposed of.
