JUSTICE PARTHA SARTHY ORAL ORDER 29-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 13.12.2019 has filed the instant application for grant of regular bail in connection with Warisaliganj P.S. Case no. 215 of 2019 registered under sections 25(1-b)(a), 26 and 35 of Arms Act. As per allegation in the FIR, a country made rifle is stated to have been recovered from the room in which the petitioner used to reside and in addition a country made revolver was also recovered from the house.

It is submitted by learned counsel for the petitioner that the allegations of recovery is false and concocted and it is for this reason that the petitioner was not arrested at the spot. The application for bail is opposed by learned APP for the State.

The petitioner is directed to be enlarged on bail in connection with Warisaliganj P.S. Case no. 215 of 2019 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada.
