The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/307/504 of the Indian Penal Code and 25(1B)a/ 26/35 of the Arms Act. It is alleged that the petitioner caused fire arm injury on the head of the informant.
It is submitted by learned counsel for the petitioner that the injury has been found marginal size lacerated wound, the doctor opined caused by fire arm, simple in nature. There is counter version of the occurrence also. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.35473 of 2015 (3) dt.04-09-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Pipariya P.S. Case No.1 of 2015, pending before the learned Chief Judicial Magistrate, Lakhisarai.
With the above observation, this application is, accordingly, disposed off.
