JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 408, 409, 420/34 of the Indian Penal Code.
The accusation is of purchase of solar lights from a different agency other than BELTRON and BREDA and, thereby, misappropriation of Rs.1,50,000/-.
It is submitted by learned counsel for the petitioner that the purchase was made in 2007-08 whereas the FIR has been registered in 2014. It is claimed that the petitioner was I/c Mukhiya only for four months when the purchase was approved by the Aam Sabha of Panchayat and the direction for purchase of the solar lights from BELTRON and BREDA was received to the Panchayat subsequent to the installation of the solar lights. Patna High Court Cr.Misc. No.34257 of 2015 (2) dt.02-09-2015 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Murar P.S. Case No.51 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
