JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners and learned counsel representing the State.
Petitioners apprehend their arrest in connection with Punpun P.S. Case No. 89 of 014 registered for the offences punishable under Sections 341, 342, 323, 316, 504/34 of the Indian Penal Code.
Allegedly, due to some dispute, the petitioners assaulted the informant resulting miscarriage and she gave birth to a premature child of seven months who died immediately after birth.
Submission is that besides oral evidence, there is no medical report to support the alleged miscarriage, and as such, the
Patna High Court Cr.Misc. No.43302 of 2014 (4) dt.20-03-2015 petitioners deserve sympathetic consideration to which the learned APP seriously opposes.
Considering that allegedly, the petitioners assaulted the informant who was pregnant which caused miscarriage, and as such, this Court is not persuaded to grant the privilege of prearrest bail to the petitioners, accordingly, their such prayer stands rejected.
However, in case and if so advised, the petitioners surrender and seek regular bail before the court below, then their prayer for bail shall be considered on its own merit on the same day without being prejudiced by the present order. (Jitendra Mohan Sharma, J) avin/- U T
