The petitioner seeks bail in connection with Patori P.S. Case No. 209 of 2017 dated 04.06.2017 instituted for the offences under Sections 304(B), 201 and 34 of the Indian Penal Code.

A report has been called for regard the stage of the case. The report has been received. The case is still at the stage of framing of the charge.

The petitioner is the younger brother of the husband of the deceased. Though there is allegation in the FIR of demand of dowry and resultant killing of the deceased but the allegations are of general and omnibus nature.

Patna High Court Cr.Misc. No.48217 of 2017 (4) dt.02-01-2018 Learned counsel for the petitioner has submitted that the deceased was suffering from stomach ailment for which she was being regularly treated. The deceased did not respond to the treatment and died in hospital. It has further been submitted that this fact was known to the informant and other members of her family but because of the death of the deceased and thereby snapping of the relation between the two families, the present case has been lodged. However, later when the father of the deceased realized the futility of continuing with this kind of litigation, he had made attempts to have the matter settled. Though in a case of Section 304(B), there is no possibility of any settlement but there are no materials against the petitioner in the present case.

It has been submitted that the deceased died her natural death. The petitioner is in custody since 05.06.2017. Regard being had to the facts aforesaid, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Patory P.S. Case No. 209 of 2017.
