17-11-2017 Heard Sri Bindhya Keshri Kumar, learned senior counsel assisted by Sri Birendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. Two petitioners, who are driver and khalasi respectively of a vehicle and in custody since 30-08-2017 in Mahandiya P.S. Case No. 77 of 2017 registered for offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail.

Learned senior counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioners are having clean antecedent. It was further argued that petitioners were not at all aware about keeping of

Patna High Court Cr.Misc. No.55466 of 2017(2) dt.17-11-2017 2/2 such huge quantity of Indian make foreign liquor, only after interception of the vehicle, this fact was noticed by the petitioners that on the truck, such huge quantity of liquor was concealed.

Be that as it may, considering the nature of accusation, clean antecedent as well as period of custody, let both petitioners namely Mahendra Singh and Ramesh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.D.J.-II, Jehanabad in connection with Mahandiya P.S. Case No. 77 of 2017, with condition that one of the bailor must be blood relation of the petitioners. (Rakesh Kumar, J.) anay U T
