For the Petitioner/s : Mr. Kumar Ravish For the Opposite Party/s : Mr. U.L.Verma (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 06-04-2015 Heard both sides.

The petitioners apprehend their arrest in Runnisaidpur P.S. Case No. 237/14(G.R. No. 2109/2014) under section 307 and other sections of the Indian Penal Code.

The informant alleged that the mother of petitioner no.1 came to him and disclosed that his son and daughter-in-law were bent upon to kill her. While the informant was ready to save the mother of petitioner no.1, petitioner no.1 and his wife assaulted the informant with Katta and caused injury on his head. Informant fell down on the ground becoming unconscious.

Patna High Court Cr.Misc. No.41019 of 2014 (3) dt.06-04-2015 2 / 2 Learned counsel for the petitioners submits that on the same day petitioner no.1 filed Runisaidpur P.S. Case No. 258 of 2014 making allegation against the informant that while his mother and sister were quarrelling with his wife petitioner no.1 came to pacify the matter, but the informant Harishankar Singh assaulted the petitioner. It is further submitted that the informant has got criminal antecedents which would appear from Annexure3 series. As per the injury report, the informant received simple injury. It appears that petitioner no.1 and his wife were quarrelling with his mother and when the informant tried to save them, the petitioner and his wife assaulted on the head of the informant.

Considering the facts, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) B.Roy/- U
