====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2026 Heard learned counsel for the petitioners and the State.
2. Petitioners seek regular bail in connection with Banka P. S. Case No. 237 of 2025 registered for the offences punishable under Sections 103(1), 238, 61(1) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, informant alleges that the F.I.R. named accused persons, including these petitioners, committed murder of her husband, due to monetary dispute.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Petitioners have falsely been implicated in this case merely

From perusal of the F.I.R. it is apparent that informant is not an eye witness of the occurrence and at best, these petitioners were seen at the place of occurrence. During investigation, no one has claimed to have seen this petitioner committing the offence. Moreover, during investigation, it was found that the deceased was a drunkard and died after consuming country made liquor. Petitioner are in custody since 04.12.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, period of custody and materials available on record, this bail application is allowed. The petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.
